TMRA On Line Auction User Agreement

Using TMRA Online Auction Services:
By using our services it is assumed that you have read the attached provided here, and are expected to agree and abide by them.

Auction General Disclaimer

TMRA Online is a service for buyers to bid through an online auction process. TMRA Online may take action against a registered user for their conduct, and reserve the right to exclude any company or representative from access to our services if we determine that their actions are not conformable to normal procedure. These Terms and Conditions govern the auction and related services provided by TMRA Online through the Website, and the use of the Website. By accessing or using the Services or the Website, or by registering as either a buyer or seller, you agree that (1) you have read this entire agreement, (2) you fully understand this agreement and (3) you are bound by this agreement. If you do not agree to the Terms and Conditions, you may not access or use the service or the website. If you do not understand the Terms and Conditions, please contact TMRA.
Owner and or Tony Montgomery Realty & Auction Company reserve the right to accept or reject any bid on item that is presented in this auction.

ALL ITEMS ARE SOLD AS IS, WHERE IS AND WITH ALL FAULTS

Auction Registration:

All potential buyers must register before you can participate. TMRA may deny any request for registration. You must be 18 years old to bid on any item. As a registered buyer, you agree that by placing a bid on an asset, Buyer Represents, warrants and covenants (1) You will not misrepresent your ability to close the transaction pursuant to the terms and conditions of the sale (2) that you have the capacity to close the transaction (3) that you have the actual authority to enter a bid and to enter into an agreement to purchase the asset, and (4) any bid that you make on an item constitutes a irrevocable offer to buy the item for the full amount of the bid plus any fees.

Auctions:

At TMRA online options, auctions can last up to 30 days. Length of each auction will be determined and announced prior to the start. Bidding automatically terminates at the end of the auction. When the auction ends, E-mail will notify high bidders with a follow up phone contact. All sales are final. No returns or refunds will be permitted, unless authorized by the seller in writing. If a dispute should arise, records kept by TMRA Online shall prevail.


Auction Bidding:

After registration is completed, you will be given a password to use with your user name. You may then proceed to bid on an item. On every item in an auction, a minimum bid and a minimum increase in bid (increment) is set by the system. The software will not accept a bid lower than the minimum or the current bid. On any item, you may enter a Maximum Bid. This bid is confidential, and will be used by the system to increase your bid automatically in case another bidder, according to the minimum bid increment outbids you. This feature will allow the system to bid on your behalf up to your maximum bid. In the event of a bid within 2 minutes of the closing of the item, the item bid time will be extended for 3 minutes, until no activity. High bidder will be notified. TMRA Company, it's agents or representatives, reserve the right to bid on behalf of customers who have contacted us that do not have computer access or on behalf of the seller.

Auction Closing and Payment:

Each auction has it’s own ending time listed on the auction form. Auctions automatically end at that time, unless as noted above. Email notifications of successful bids will be sent out, followed with a phone contact. TMRA may at its discretion, charge a buyer’s premium or other service charge on assets sold. All such charges will be indicated in the relevant auction brochure, or other clearly marked area on the Website. If charged, the buyer’s premium shall be a percentage of the sales price of each item sold and shall be collected by TMRA directly from successful bidder in addition to the purchase price bid.
If the winning bidder on any item defaults on payment, necessitating legal action, any legal expense incurred by TMRA in the pursuit of payment will be the responsibility of the bidder. In the absence of legal action, any item not picked up by the close of business will revert to the seller or TMRA to be held or disposed of at their discretion.

TMRA will announce pickup times, shipping options or other ways to take possession of your item. Items become the property of the purchaser upon the closing of the auction and are the sole responsibility of the successful bidder. Transportation, removal costs, shipping or other costs of possession are the sole responsibility of the successful bidder. TMRA online or its affiliates shall be held harmless on any issues arising from the result of the auction, collection or transportation of items.

This on line user agreement and it’s terms and conditions, and all questions with respect to the interpretation of these terms, shall be governed by and construed in accordance with the internal laws of the State in which the auction is held, without regard to conflict of laws provisions. All bidders expressly consent to personal and exclusive jurisdiction in the courts of the State where the auction is held. You as a bidder, agree with these terms stated above, and any auction specific terms posted.
